1. Acceptance of Terms

By accessing and using YourBusinessPal ("the Service"), operated by YourBusinessPal (ABN: 69 859 401 080) ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

YourBusinessPal provides cloud-based business management software including but not limited to:

  • Client and customer relationship management
  • Job scheduling and tracking
  • Asset and equipment management
  • Staff management and timesheets
  • Document management and storage
  • Expense tracking and management
  • Quote and invoice generation
  • Automation rules and workflows

3. User Accounts and Responsibilities

3.1 Account Registration

You must provide accurate, complete, and current information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Transmit or store any unlawful, harmful, threatening, or objectionable content
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to send spam or unsolicited commercial communications

4. Subscription and Payment Terms

4.1 Subscription Plans

The Service is offered under various subscription plans as detailed on our pricing page. All prices are in Australian Dollars (AUD) and include GST where applicable.

4.2 Free Trial

We offer a 14-day free trial for new accounts. No payment information is required to start your trial. Your trial will convert to a paid subscription unless cancelled before the trial ends.

4.3 Payment and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are processed securely through Stripe
  • You authorize us to charge your payment method for all applicable fees
  • Failure to pay may result in suspension or termination of your account

4.4 Refund Policy

We offer a 30-day money-back guarantee for annual subscriptions. Monthly subscriptions are not eligible for refunds but you can cancel at any time to avoid future charges.

5. Data and Privacy

5.1 Your Data

You retain all rights, title, and interest in and to your data. We will not access, use, or disclose your data except as necessary to provide the Service or as required by law.

5.2 Data Security

We implement appropriate technical and organizational measures to protect your data against unauthorized access, alteration, disclosure, or destruction.

5.3 Data Location

Your data is stored on servers located in Australia and may be processed in Australia or other countries where we or our service providers operate.

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by YourBusinessPal and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Service Availability and Support

7.1 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance or updates.

7.2 Customer Support

Technical support is available via email at admin@yourbusinesspal.com.au during Australian Eastern Standard Time business hours (9 AM - 5 PM, Monday to Friday).

8. Limitation of Liability

To the maximum extent permitted by applicable law, YourBusinessPal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless YourBusinessPal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the cancellation feature in your account settings.

10.2 Termination by Us

We may terminate or suspend your account immediately if you breach these Terms or for any other reason with 30 days' notice.

10.3 Effect of Termination

Upon termination, your right to access the Service will cease immediately. Your data will be retained for 30 days after termination and then permanently deleted.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Australia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, or right that you may have under the Australian Consumer Law or any similar consumer protection laws in your jurisdiction which cannot be excluded, restricted, or modified.
